Portfolio Pulse is operated by Peacock Solutions SARL, a company incorporated under Swiss law, registered at the Swiss Commercial Registry (Registre du commerce vaudois), with its registered office at EPFL Innovation Park, Building D, 1015 Lausanne, Vaud, Switzerland.

Portfolio Pulse provides:

• →Data aggregation and information display for investment portfolios
• →AI-generated analytical insights
• →Portfolio tracking and organizational tools
• →Market data summaries sourced from third-party providers

Portfolio Pulse is an information and technology service, not a financial intermediary, investment adviser, broker-dealer, or regulated financial institution.

By accessing, registering for, or using Portfolio Pulse, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated by reference.

If you do not agree with any part of these terms, you must not use the service.

We believe in radical transparency about what Portfolio Pulse is and is not. To be explicit:

AI-generated insights are analytical summaries produced for informational purposes only. They do not constitute financial advice, and users should not rely on them when making investment decisions.

Market data displayed on Portfolio Pulse (including prices, indicators, and historical data) is sourced primarily from third-party providers, including but not limited to Alpha Vantage, Twelve Data, Finnhub, Financial Modeling Prep, CoinGecko, and others.

Portfolio Pulse offers AI-generated analytical insights powered by third-party AI models, including OpenAI's GPT models.

To the maximum extent permitted by Swiss law, Peacock Solutions SARL and its officers, directors, employees, and affiliates shall not be liable for:

• →Investment losses or trading decisions made based on information from the platform
• →Inaccuracies, delays, or errors in market data sourced from third-party providers
• →Errors, hallucinations, or misleading content produced by AI models
• →Service interruptions, downtime, or data loss
• →Any indirect, incidental, consequential, special, or punitive damages
• →Loss of profits, revenue, data, or business opportunities

Peacock Solutions SARL's total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of Portfolio Pulse shall not exceed the total amounts paid by you to Peacock Solutions SARL in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable Swiss law, including liability for fraud or willful misconduct.

• →Market data remains the property of the respective third-party data providers and is subject to their terms of use.
• →You retain ownership of your portfolio data (the holdings, transactions, and notes you enter). Peacock Solutions SARL claims no intellectual property rights over your personal data.
• →You may not copy, reproduce, distribute, or create derivative works from the Portfolio Pulse platform without our express written permission.

When using Portfolio Pulse, you agree to:

• →Provide accurate and truthful information when creating and maintaining your account
• →Keep your login credentials confidential and notify us immediately of any unauthorized access
• →Not attempt to reverse-engineer, decompile, disassemble, or scrape the platform
• →Not use the platform for any unlawful purpose or in violation of any applicable law or regulation
• →Not use automated tools, bots, or scripts to access the platform in ways that would overload or abuse our systems
• →Maintain one account per person — account sharing is not permitted

• →Portfolio Pulse offers Free and Pro subscription plans.
• →The Pro subscription is billed on a recurring basis via Stripe.
• →Refund policy: pro-rated refunds are available within 14 days of your initial Pro subscription purchase, in accordance with Swiss consumer law.
• →Cancellation takes effect at the end of the current billing period. You retain access to Pro features until the period expires.
• →Peacock Solutions SARL reserves the right to change pricing with 30 days' advance notice to existing subscribers.

Portfolio Pulse is provided on a "commercially reasonable efforts" basis. We strive to maintain high availability but do not offer a guaranteed uptime SLA for free-tier users.

• →We reserve the right to modify, suspend, or discontinue any feature or aspect of the service with reasonable advance notice.
• →Planned maintenance will be communicated in advance where possible.
• →We are not liable for any losses or inconvenience caused by service interruptions beyond our control.

These Terms and Conditions are governed exclusively by Swiss law, in particular the Swiss Code of Obligations (CO/OR), without reference to conflict of law rules.

Any dispute, controversy, or claim arising out of or relating to these Terms, including their validity, breach, or termination, shall be subject to the exclusive jurisdiction of the ordinary courts of Lausanne, Vaud, Switzerland.

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

Peacock Solutions SARL may update these Terms and Conditions from time to time. For material changes, we will provide at least 30 days' advance notice via email or in-app notification before the new terms take effect.

Continued use of Portfolio Pulse after the notice period constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the service before the new terms take effect.
